If you have a disability you now have more protection from discrimination after a landmark case in the House of Lords. This case affects people with fluctuating impairments: this means if your impairment is one which is able to change in how much it affects you over time.
If your impairment affects you less now than it has done before, but it is likely that it will affect you more again in the future, you will still be considered disabled under the Disability Discrimination Act 1995. This means that you will be protected from discrimination under the Act even if your impairment affects you less now than in the past.
This ruling provides added protection for people with fluctuating conditions such as mental health issues.
